Eligibility requirements
To qualify for a skilled worker visa, an applicant must:
- Have a job offer from a Home Office licensed sponsor
- Have a certificate of sponsorship from that sponsor
- Be taking up a role that appears on the eligible occupations list
- Meet the relevant salary threshold for the role (the general threshold or the specific occupation threshold, whichever is higher)
- Meet the English language requirement
- Be able to support themselves financially
Salary thresholds
Salary thresholds for the skilled worker visa were significantly increased in April 2024. The general salary threshold is currently £38,700 per year. Specific occupation codes have their own thresholds which may be higher. New entrant rates and shortage occupation discounts that previously applied have been substantially reduced.
It is essential to check the applicable threshold for the specific occupation code before applying, as errors are a common cause of refusal.
Sponsor licence
An employer wishing to sponsor overseas workers must hold a valid sponsor licence from the Home Office. I advise employers on obtaining and maintaining a sponsor licence, including compliance obligations, record-keeping requirements, and responding to Home Office audits.
